These Terms of Use govern access to and use of the following digital services provided by CodingFreaks (“Provider”):

- CodingFreaks-CookieDatabase
- CodingFreaks-CookieScanner
- CodingFreaks-SEOAuditing-Tool
By using any of these services (“Services”), you agree to these Terms of Use.
1. Scope of Services
The Services consist of software tools, web services, databases, and automated analyses intended to support website owners, developers, and operators.
The exact scope, features, and limitations of each Service are described on the Provider’s website and may change at any time.
The Services are provided as-is and as available.
2. No Warranty – Services Provided “As Is”
- The Provider does not provide any warranty, explicit or implied.
- No guarantee is given that the Services will be error-free, uninterrupted, free from defects, complete, accurate, or suitable for any specific purpose.
- The Provider does not guarantee any specific results, including but not limited to compliance outcomes, SEO performance, cookie detection accuracy, database correctness, or technical reliability.
- All outputs - scan results, analyses, classifications, reports, and data, are generated automatically and may contain errors.
Users acknowledge that they rely on the Services solely at their own risk.
3. Limitation of Liability
To the fullest extent legally permissible under Austrian law (§§ 1293 ff ABGB) and EU consumer protection rules:
The Provider is not liable for:
- direct damages,
- indirect damages,
- consequential damages,
- financial losses,
- data loss or data corruption,
- loss of profits,
- business interruption,
- reputational damage,
- incorrect analysis results,
- incorrect or incomplete database entries,
- missed or undetected cookies/tracking technologies,
- any decisions made or actions taken based on Service outputs.
The Provider is not liable for damages resulting from:
- use or non-use of the Services,
- technical failures, downtime, system errors, or outages,
- third-party integrations or dependencies,
- API usage or external data sources,
- user misconfiguration,
- updates, modifications, or discontinuation of Services.
- personal injury caused by negligence,
- intentional misconduct (Vorsatz).
- any decisions made or actions taken based on Service outputs.
Apart from these mandatory exceptions, all liability is excluded.
4. User Responsibilities
Users agree to:
- use the Services in compliance with all applicable laws (incl. GDPR, ePrivacy, TKG 2021),
- verify all results independently,
- not rely solely on the Services for legal, compliance, or operational decisions,
- maintain backups of all relevant data.
The Services are not a substitute for legal advice, compliance audits, or professional consultation.
5. Intellectual Property
All software, content, structures, databases, and materials provided within the Services remain the intellectual property of the Provider.
Users receive a limited, non-exclusive, revocable right to use the Services during the subscription or free access period.
Reverse engineering, copying, resale, redistribution, or unauthorized use is prohibited.
6. Modifications, Updates, and Discontinuation
The Provider reserves the right, at any time and without prior notice, to:
- modify Services or features,
- perform maintenance or downtime,
- update, limit, or discontinue parts of or entire Services,
- revise these Terms of Use.
Changes become effective upon publication on the Provider’s website.
Continued use of the Services constitutes acceptance of the updated Terms.
7. Termination of Access
The Provider may suspend or terminate a user’s access to the Services if:
- Terms of Use are violated,
- misuse or harmful behavior is detected,
- legal requests or regulatory requirements demand it.
Upon termination, the user’s right to use the Services ends immediately.
8. Data Protection
Processing of personal data is governed by the Provider’s Privacy Policy in accordance with GDPR and Austrian data protection laws.
9. Severability Clause
If any part of these Terms is or becomes invalid, the remaining provisions remain unaffected.
Invalid provisions shall be replaced by legally valid ones that most closely reflect the original intent.
